New Delhi: Certain sections of the media have mistakenly reported about the cross examination of Medha Patkar by Gujarat based 'NGO', National Council for Civil Liberties in a Delhi Court. These reports have been giving wrong facts and not bringing out the true picture. The fact is that the case that was to come today before the Metropolitan Magistrate of Saket Court, Delhi was the case filed by Medha Patkar against the deliberately defamatory advertisement put forth by the said NGO in Gujarat. The person putting up the ad has also been an accused in the case filed for the attack on media persons and Medha Patkar at the Sabarmati ashram during the post-riots peace meeting in April 2002. He has been accused along with the then Chairman, Bharatiya Yuva Morcha and then Councellor of BJP, Ahmedabad, Mr. Amit Popatlal Shah.
The same NGO that had made allegations against NBA and Medha Patkar also approached the Supreme Court in 2006, where his case was rejected and he was directed to pay costs for leveling frivolous allegations. NCCL is also involved in other cases against Prof. Ashish Nandy and Mallika Sarabhai which too were dismissed by the Apex Court.
The defamation case filed by Medha Patkar on the basis of the advertisements were to be heard today, while another defamation case filed by the NGO for some press statement believed by them to be defamatory action on the part of NBA. This case was to come up tomorrow i.e. on 2nd March. Both the cases have been postponed; in absence of the Metropolitan Magistrate and the cases have been listed for further hearing and recording of evidence on May 23rd.
